What is Burglary?

Burglary is defined as the unlawful entry of a structure to commit a felony or theft. The use of force to gain entry is not required to classify an offense as a burglary. Burglary is categorized into three sub classifications: forcible entry, unlawful entry where no force is used, and attempted forcible entry.

If you break into a home, that's a burglary. If you break into a vehicle, mobile home, storage facility, garage, etc, that's burglary. It doesn't matter if someone is home or not. 

The crime is committed when the person is "unlawfully" in a place he is not authorized to be in.

Understand that the law is based on it's written meaning. A District Attorney could place you in jail for a very long time based on the meaning and wording of the law, not on your intent. State laws differ from California to New York from Chicago to Houston, Texas, etc.

How is a burglary normally committed?
A typical burglary is committed when a criminal goes into a house or another building looking to steal property and does so. Although it is common for the building to be broken into, perhaps by breaking a window or forcing a door, this does not have to happen for a burglary to be committed. A burglar can just as easily walk in, as a trespasser, through an unlocked or open door.

What is the difference between burglary and robbery?
It is not uncommon for people to say ‘My house has been robbed’ when they actually mean they have been 'burgled'. Unless a degree of violence is used or threatened, it is NOT robbery.
